1. Acceptance of these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Mechanic Jobs Australia website, mobile services, software, applications and any related services (collectively referred to as the “Platform”).

By accessing, browsing, registering for an account, purchasing services from, or otherwise using the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms together with our Privacy Policy and any other policies published on the Platform.

If you do not agree with these Terms, you must immediately stop using the Platform.

These Terms form a legally binding agreement between you and Mechanic Jobs Australia.

2. Definitions

Candidate means any mechanic, apprentice, technician, tradesperson or other individual seeking employment or business opportunities.

Content means all information, text, resumes, job advertisements, photographs, logos, graphics, videos, documents, AI-generated images, comments, messages and other material uploaded or published on the Platform.

Employer means any person or business advertising employment or recruitment opportunities.

Platform means the Mechanic Jobs Australia website and associated services.

User means any individual or organisation accessing or using the Platform.

Workshop includes mechanical workshops, automotive repair businesses, heavy vehicle repairers, agricultural machinery businesses, earthmoving repair businesses, marine repairers, motorcycle workshops and similar businesses.

“We”, “Us” and “Our” refer to Mechanic Jobs Australia.

“You” and “Your” refer to any person or organisation using the Platform.

3. About Mechanic Jobs Australia

Mechanic Jobs Australia is an online employment marketplace designed to connect mechanics, apprentices, technicians and other automotive industry professionals with employers throughout Australia.

The Platform allows employers to advertise employment opportunities and allows job seekers to create profiles, upload resumes and apply for available positions.

Mechanic Jobs Australia is an online marketplace only.

We are not:

  • an employer;
  • a recruitment agency;
  • a labour hire provider;
  • an employment business;
  • a staffing agency;
  • a professional licensing authority;
  • a training organisation;
  • a migration agent;
  • a workplace investigator;
  • a workplace relations adviser; or
  • an agent acting on behalf of any employer or candidate.

Mechanic Jobs Australia does not participate in recruitment decisions, interviews, employment negotiations, wage discussions, employment contracts, workplace supervision, disciplinary action, dismissal decisions or workplace disputes.

Any employment, contracting or business relationship created through the Platform exists solely between the relevant employer and candidate.

4. Eligibility

To use the Platform you must:

  • be at least 18 years of age;
  • have legal capacity to enter into binding agreements;
  • comply with all applicable Australian laws;
  • provide accurate registration information; and
  • use the Platform only for lawful purposes.

If you are registering on behalf of a company, partnership, trust or other organisation, you warrant that you have authority to bind that organisation to these Terms.

5. User Accounts

Certain features of the Platform require users to register an Account.

When creating an Account you agree to:

  • provide complete, current and accurate information;
  • keep your information updated;
  • maintain the confidentiality of your login credentials;
  • use a secure password;
  • immediately notify us of any unauthorised use of your Account;
  • ensure that all activity conducted through your Account complies with these Terms.

You remain responsible for everything that occurs through your Account unless Australian law provides otherwise.

Mechanic Jobs Australia may refuse any registration application without providing reasons.

6. Employer Accounts

Employers are responsible for ensuring that all information published on the Platform is accurate, lawful and current.

By creating an Employer Account you warrant that:

  • your business is genuine;
  • you have authority to advertise employment opportunities;
  • information you publish is accurate;
  • advertised positions are genuine;
  • remuneration and employment conditions comply with applicable Australian law;
  • your advertisements do not mislead applicants.

Employers remain solely responsible for recruitment decisions made using the Platform.

Mechanic Jobs Australia does not review or approve individual hiring decisions.

7. Candidate Accounts

Candidates are responsible for maintaining accurate profiles.

By creating a Candidate Account you warrant that:

  • information contained in your profile is true and correct;
  • qualifications listed are genuine;
  • licences remain current;
  • work history is accurate;
  • certifications are authentic;
  • references are provided honestly;
  • you have permission to upload all documents and photographs.

Mechanic Jobs Australia may remove profiles containing false, misleading or deceptive information.

8. No Verification of Users

Mechanic Jobs Australia does not routinely verify:

  • identities;
  • qualifications;
  • licences;
  • trade certificates;
  • resumes;
  • references;
  • employment history;
  • police clearances;
  • visas;
  • citizenship status;
  • insurance;
  • ABN registrations;
  • business registrations;
  • financial standing; or
  • any other information submitted by users.

Unless expressly stated otherwise, all information published on the Platform is supplied by users.

Users are solely responsible for carrying out their own enquiries, reference checks, licence checks, background checks and due diligence before entering into employment or business relationships.

Mechanic Jobs Australia accepts no responsibility for reliance placed upon user-provided information.

9. No Employment Relationship

Mechanic Jobs Australia simply provides technology that enables employers and candidates to connect.

Mechanic Jobs Australia is not a party to any:

  • employment contract;
  • contractor agreement;
  • labour hire arrangement;
  • wage negotiation;
  • workplace dispute;
  • dismissal;
  • disciplinary process;
  • workers compensation claim;
  • unfair dismissal claim;
  • discrimination complaint;
  • workplace investigation; or
  • industrial relations matter.

Any legal relationship formed through the Platform exists exclusively between the employer and the candidate.

Mechanic Jobs Australia bears no responsibility for the actions, omissions or conduct of either party.

10. No Guarantee

Mechanic Jobs Australia makes no guarantee that:

  • candidates will obtain employment;
  • employers will receive applications;
  • applications will be successful;
  • interviews will occur;
  • positions will be filled;
  • employment will continue for any period;
  • candidates will possess the skills claimed;
  • employers will honour advertised conditions; or
  • users will achieve any commercial benefit from using the Platform.

The Platform is provided as a marketplace only.

Success depends entirely upon the actions and decisions of individual users.

11. User Content

Users may upload, publish or submit Content to the Platform, including but not limited to:

  • resumes;
  • job advertisements;
  • business profiles;
  • mechanic profiles;
  • photographs;
  • logos;
  • cover images;
  • videos;
  • licences;
  • qualifications;
  • certificates;
  • descriptions;
  • comments;
  • reviews (if enabled);
  • messages; and
  • other material.

Users remain solely responsible for all Content they upload or publish.

Mechanic Jobs Australia does not routinely monitor, verify, approve or endorse user Content prior to publication.

Publication of Content on the Platform does not indicate that Mechanic Jobs Australia approves, recommends or verifies that Content.

12. Licence to Use User Content

By uploading or submitting any Content to the Platform, you grant Mechanic Jobs Australia a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to:

  • host;
  • store;
  • reproduce;
  • display;
  • publish;
  • communicate;
  • transmit;
  • adapt;
  • resize;
  • optimise;
  • back up; and
  • otherwise use your Content,

for the purposes of operating, maintaining, securing, improving, marketing and promoting the Platform.

This licence continues for as long as the Content remains on the Platform and for any additional period reasonably required for backup, legal compliance or archival purposes.

You retain ownership of your original intellectual property.

13. User Warranties

By uploading Content, you warrant that:

  • you own the Content or have all necessary rights and permissions to use it;
  • the Content does not infringe any copyright, trademark, moral right, privacy right or other legal right;
  • the Content is accurate and not misleading;
  • the Content does not impersonate another person or business;
  • the Content complies with Australian law; and
  • the Content does not breach these Terms.

You are solely responsible for any claims arising from Content you upload.

14. AI-Generated Content and Images

Mechanic Jobs Australia recognises that users may choose to use artificial intelligence (“AI”) tools to create or edit profile photographs, business images, logos, written content or other material.

AI-generated Content is permitted provided that:

  • the user has the legal right to use that Content;
  • the Content does not infringe another person’s intellectual property rights;
  • the Content is not deceptive or misleading;
  • the Content does not falsely represent qualifications, licences, work experience or identity;
  • the Content does not impersonate another individual or business without authorisation; and
  • the Content complies with all applicable laws.

Users remain solely responsible for all AI-generated Content they publish.

Mechanic Jobs Australia does not verify whether images, photographs or other Content have been created or modified using artificial intelligence.

Mechanic Jobs Australia accepts no responsibility for claims arising from AI-generated Content uploaded by users.

15. Photographs and Profile Images

Users may upload photographs and profile images provided they have permission to use those images.

Users must not upload:

  • copyrighted photographs without permission;
  • images copied from another website without authorisation;
  • misleading profile photographs;
  • deepfake images intended to deceive;
  • offensive or inappropriate images;
  • images that impersonate another person;
  • images that infringe another person’s privacy;
  • unlawful material; or
  • images that violate these Terms.

Mechanic Jobs Australia reserves the right to remove any image at its sole discretion.

16. Business Logos

Businesses warrant that they own, or are authorised to use, any logos, trademarks or branding uploaded to the Platform.

Mechanic Jobs Australia accepts no responsibility for trademark or copyright disputes relating to uploaded logos.

17. Copyright and Intellectual Property

All intellectual property rights relating to the Platform, including software, branding, design, graphics, logos, databases, layouts, written material and functionality, remain the property of Mechanic Jobs Australia or its licensors unless otherwise stated.

Nothing contained within these Terms transfers ownership of any intellectual property to users.

Users must not:

  • copy;
  • reproduce;
  • distribute;
  • republish;
  • sell;
  • modify;
  • reverse engineer;
  • commercially exploit; or
  • create derivative works from,

any part of the Platform without prior written consent, except as permitted by law.

18. Copyright Complaints

If you believe Content published on the Platform infringes your copyright or other intellectual property rights, you may notify Mechanic Jobs Australia by providing:

  • your name and contact details;
  • a description of the allegedly infringing material;
  • sufficient information to locate the material;
  • evidence of your ownership or authority; and
  • a statement that your complaint is made in good faith.

Mechanic Jobs Australia may investigate the complaint and remove, disable or restrict access to the Content while the matter is assessed.

Mechanic Jobs Australia is not required to determine ownership of disputed intellectual property and may refer parties to resolve disputes directly or through appropriate legal processes.

19. Right to Remove Content

Mechanic Jobs Australia may remove, edit, disable, restrict or refuse to publish any Content at any time and without prior notice if we reasonably believe the Content:

  • breaches these Terms;
  • is unlawful;
  • is misleading or deceptive;
  • infringes intellectual property rights;
  • contains false information;
  • may expose the Platform to legal liability;
  • promotes scams or fraudulent activity;
  • contains malware or malicious code;
  • is offensive, abusive or defamatory; or
  • is otherwise considered unsuitable for the Platform.

Mechanic Jobs Australia is under no obligation to restore removed Content.

20. Anti-Scraping and Automated Access

Users must not, without our prior written consent:

  • scrape or harvest data from the Platform;
  • copy resumes or candidate information in bulk;
  • use bots, crawlers, spiders or automated software;
  • download substantial portions of the Platform;
  • bypass security measures;
  • attempt to access restricted areas;
  • interfere with Platform functionality; or
  • use any Content from the Platform to train, develop or improve artificial intelligence or machine learning systems.

Mechanic Jobs Australia reserves the right to block, suspend or permanently ban users who engage in unauthorised automated access.

Mechanic Jobs Australia may pursue legal remedies for unauthorised scraping or misuse of Platform data.

21. User Responsibility for Uploaded Content

Users acknowledge that they are solely responsible for all Content they upload or publish.

Mechanic Jobs Australia does not accept responsibility for:

  • errors in user Content;
  • misleading statements;
  • fake profiles;
  • fake job advertisements;
  • inaccurate qualifications;
  • forged licences;
  • misleading AI-generated material;
  • copyright infringement by users;
  • defamatory statements;
  • offensive material; or
  • disputes arising from user Content.

Users agree to indemnify Mechanic Jobs Australia for any claim arising from Content they publish.

22. Job Advertisements

Employers are solely responsible for all job advertisements published on the Platform.

By publishing a job advertisement, an Employer warrants that:

  • the position is genuine;
  • the Employer has authority to advertise the position;
  • the advertisement accurately describes the role;
  • all remuneration, benefits and employment conditions are described honestly;
  • the position complies with all applicable Australian laws;
  • the advertisement is not misleading or deceptive; and
  • the Employer intends to recruit for the advertised position.

Mechanic Jobs Australia does not review every advertisement before publication and does not guarantee the accuracy of any job advertisement.

23. Employer Responsibilities

Employers agree to:

  • comply with all applicable Commonwealth, State and Territory laws;
  • comply with the Fair Work Act 2009 (Cth), anti-discrimination laws, workplace health and safety legislation and all other applicable employment laws;
  • treat applicants fairly and professionally;
  • maintain the confidentiality of applicant information;
  • use applicant information only for genuine recruitment purposes;
  • promptly remove advertisements that are no longer current;
  • avoid misleading statements regarding wages, benefits or employment conditions;
  • ensure all advertised licences, certifications or experience requirements are lawful.

Employers are solely responsible for all recruitment decisions made using the Platform.

24. Candidate Responsibilities

Candidates agree that they will:

  • provide truthful information;
  • maintain accurate profiles;
  • update qualifications when they expire;
  • keep licences current;
  • comply with Australian laws;
  • attend interviews honestly and professionally;
  • avoid misrepresenting skills or experience;
  • refrain from submitting fraudulent applications;
  • maintain the confidentiality of employer information obtained through the Platform.

Candidates are responsible for ensuring they have any licences, trade qualifications, work rights or certifications required for employment.

25. Background Checks and Due Diligence

Mechanic Jobs Australia does not perform background checks on users unless expressly stated.

Users are solely responsible for undertaking any checks they consider appropriate before entering into employment or business relationships, including:

  • reference checks;
  • licence verification;
  • qualification verification;
  • trade certificate verification;
  • visa or work rights verification;
  • police checks;
  • Working With Children Checks (where applicable);
  • medical assessments;
  • drug and alcohol testing;
  • insurance verification; and
  • any other due diligence considered necessary.

Mechanic Jobs Australia accepts no responsibility for the outcome of such checks or for any decision made based on information published on the Platform.

26. Workplace Health and Safety

Mechanic Jobs Australia is not responsible for:

  • workplace safety;
  • workplace conditions;
  • equipment safety;
  • hazardous work environments;
  • supervision;
  • training;
  • compliance with workplace health and safety legislation; or
  • injuries occurring during employment.

Employers remain solely responsible for providing safe workplaces and complying with all applicable workplace health and safety legislation.

27. Equal Opportunity and Discrimination

Employers must comply with all applicable anti-discrimination, equal opportunity and workplace legislation.

Job advertisements must not unlawfully discriminate on the basis of race, colour, sex, gender identity, age, disability, religion, political opinion, marital status, pregnancy, sexual orientation or any other protected characteristic.

Mechanic Jobs Australia reserves the right to remove advertisements that appear to breach anti-discrimination laws.

28. Prohibited Job Advertisements

Employers must not advertise:

  • fake jobs;
  • unlawful employment;
  • pyramid schemes;
  • commission-only roles where prohibited by law;
  • misleading employment opportunities;
  • jobs involving illegal conduct;
  • discriminatory positions;
  • deceptive recruitment practices;
  • advertisements intended solely to collect personal information; or
  • positions that may expose users to fraud.

Mechanic Jobs Australia may remove such advertisements immediately without notice.

29. Recruitment Agencies and Labour Hire Providers

Unless expressly authorised in writing by Mechanic Jobs Australia, recruitment agencies, labour hire companies, employment brokers and third-party staffing providers must not use the Platform.

Mechanic Jobs Australia may suspend or terminate any account believed to be operating as a recruitment agency or labour hire provider.

Any fees paid by prohibited users may be retained to cover administrative, investigation and enforcement costs and may not be refunded, except where required by law.

30. Applications Submitted Through the Platform

Mechanic Jobs Australia provides technology that allows candidates to submit applications to Employers.

Mechanic Jobs Australia does not:

  • review applications for accuracy;
  • recommend particular candidates;
  • rank applicants based on suitability unless expressly stated;
  • guarantee delivery of applications;
  • guarantee that Employers will review applications; or
  • participate in recruitment decisions.

Candidates acknowledge that submission of an application does not guarantee an interview or employment.

31. Messaging and Communications

Where messaging or communication features are available, users agree that they will:

  • communicate respectfully;
  • avoid harassment or abuse;
  • avoid discriminatory conduct;
  • avoid threats or intimidation;
  • avoid spam;
  • avoid scams;
  • avoid phishing attempts;
  • avoid malicious links or attachments.

Mechanic Jobs Australia may monitor communications where permitted by law for security, fraud prevention, moderation or investigation purposes.

32. Reviews and Ratings

If review or rating features become available, users agree that reviews must:

  • be truthful;
  • be based upon genuine experiences;
  • not be defamatory;
  • not contain confidential information;
  • not contain personal attacks;
  • not include unlawful material.

Mechanic Jobs Australia reserves the right to edit, moderate or remove reviews at its discretion.

Publication of a review does not indicate endorsement by Mechanic Jobs Australia.

33. Paid Services

Mechanic Jobs Australia may offer paid services including:

  • featured job advertisements;
  • premium business profiles;
  • subscription plans;
  • advertising packages;
  • promotional services; and
  • other premium features.

The pricing, inclusions and duration of paid services will be displayed at the time of purchase.

34. Payments

Users purchasing paid services agree to pay all applicable fees.

All prices are quoted in Australian Dollars (AUD) unless otherwise stated.

Where applicable, prices include Goods and Services Tax (GST).

Payments must be made using approved payment methods.

Mechanic Jobs Australia may suspend paid services where payment is unsuccessful.

35. Refunds

Unless otherwise required by Australian Consumer Law or expressly stated otherwise:

  • change of mind does not entitle a user to a refund;
  • partially used advertising packages are not refundable;
  • subscription fees already paid are not refundable;
  • unused promotional services may expire without refund.

Nothing in this clause limits any rights that cannot legally be excluded under Australian Consumer Law.

36. Future Services

Mechanic Jobs Australia may introduce additional services, features or subscription products from time to time.

Your continued use of those services will be governed by these Terms together with any additional conditions published for those services.

37. Prohibited Conduct

Users must not use the Platform to:

  • publish false, misleading or deceptive information;
  • impersonate another person or business;
  • upload forged licences, qualifications or certificates;
  • create fake profiles or fake business accounts;
  • publish fraudulent job advertisements;
  • harass, threaten, intimidate or abuse other users;
  • upload defamatory, offensive, obscene or unlawful material;
  • distribute malware, ransomware, viruses or other harmful code;
  • interfere with the security or operation of the Platform;
  • attempt unauthorised access to accounts, databases or systems;
  • collect personal information without lawful authority;
  • send spam or unsolicited communications;
  • engage in phishing, scams or fraudulent conduct;
  • infringe another person’s intellectual property rights;
  • use the Platform for any unlawful purpose; or
  • encourage or assist another person to breach these Terms.

Mechanic Jobs Australia may investigate suspected breaches and cooperate with law enforcement or regulatory authorities where required by law.

38. Suspension and Termination

Mechanic Jobs Australia may, at its sole discretion and without prior notice, suspend, restrict or permanently terminate any Account where we reasonably believe that a user has:

  • breached these Terms;
  • published false or misleading information;
  • uploaded unlawful Content;
  • infringed copyright or intellectual property rights;
  • impersonated another person or business;
  • engaged in fraudulent conduct;
  • created multiple Accounts to avoid restrictions;
  • attempted to compromise the security of the Platform;
  • used automated tools contrary to these Terms;
  • engaged in abusive or inappropriate behaviour; or
  • otherwise used the Platform in a manner that may expose Mechanic Jobs Australia or its users to legal, financial or reputational risk.

Termination of an Account does not affect any rights or obligations that arose before termination.

Mechanic Jobs Australia is not liable for any loss resulting from the suspension or termination of an Account where permitted by law.

39. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how personal information is collected, used, stored and disclosed.

By using the Platform, you acknowledge that you have read the Privacy Policy and consent to the handling of your personal information in accordance with that policy.

40. Data Security

Mechanic Jobs Australia takes reasonable steps to protect the security of the Platform and personal information.

However, no website, internet transmission, cloud service or computer system can be guaranteed to be completely secure.

To the maximum extent permitted by law, Mechanic Jobs Australia is not liable for loss arising from:

  • cyber attacks;
  • hacking;
  • malware;
  • unauthorised access;
  • denial of service attacks;
  • system failures;
  • internet outages;
  • corruption of data;
  • transmission failures; or
  • events beyond our reasonable control.

Users acknowledge the inherent risks associated with using internet-based services.

41. Website Availability

Mechanic Jobs Australia aims to provide reliable access to the Platform but does not guarantee uninterrupted availability.

The Platform may be temporarily unavailable due to:

  • maintenance;
  • software upgrades;
  • security updates;
  • technical failures;
  • internet service interruptions;
  • third-party provider outages; or

Mechanic Jobs Australia is not liable for losses arising from temporary interruptions to the Platform.

42. Third-Party Services and Links

The Platform may contain links to third-party websites, payment providers, mapping services, social media platforms or other external services.

Mechanic Jobs Australia does not control or endorse third-party websites and is not responsible for:

  • their content;
  • their security;
  • their privacy practices;
  • their availability; or
  • any products or services they provide.

Users access third-party websites at their own risk.

43. Limitation of Liability

To the maximum extent permitted by law, Mechanic Jobs Australia excludes all liability for any loss or damage arising from the use of the Platform, including but not limited to:

  • loss of employment;
  • loss of business opportunity;
  • recruitment costs;
  • hiring decisions;
  • workplace disputes;
  • workplace injuries;
  • loss of income;
  • loss of profits;
  • reputational damage;
  • business interruption;
  • data loss;
  • indirect loss;
  • consequential loss;
  • incidental loss; and
  • special damages.

Mechanic Jobs Australia is not responsible for the acts, omissions or conduct of Employers, Candidates or other users.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

44. Indemnity

You agree to indemnify, defend and hold harmless Mechanic Jobs Australia, its owner, directors, employees, contractors, consultants, agents and representatives from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable legal costs) arising from or relating to:

  • your use of the Platform;
  • your breach of these Terms;
  • your breach of any law;
  • Content you upload or publish;
  • infringement of intellectual property rights;
  • misleading or deceptive conduct;
  • employment disputes;
  • disputes between users;
  • negligence or wrongful acts by you; or
  • claims brought against Mechanic Jobs Australia because of your conduct.

This clause survives termination of your Account.

45. Force Majeure

Mechanic Jobs Australia is not liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control, including:

  • natural disasters;
  • floods;
  • bushfires;
  • pandemics;
  • industrial disputes;
  • acts of government;
  • telecommunications failures;
  • power outages;
  • cyber incidents;
  • war;
  • terrorism; or
  • failures of third-party service providers.

46. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where the law permits limitation of liability, Mechanic Jobs Australia’s liability is limited to the maximum extent permitted by law.

47. Changes to the Platform

Mechanic Jobs Australia may, at any time and without prior notice:

  • add new features;
  • remove features;
  • change functionality;
  • modify pricing;
  • introduce subscriptions;
  • discontinue services; or
  • update software.

We will endeavour to provide reasonable notice of significant changes where practical.

48. Changes to these Terms

Mechanic Jobs Australia may amend these Terms from time to time.

Updated Terms become effective when published on the Platform unless a later effective date is specified.

Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.

49. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary.

The remaining provisions will continue in full force and effect.

50. Waiver

Failure by Mechanic Jobs Australia to enforce any provision of these Terms does not constitute a waiver of any right or remedy.

Any waiver must be in writing.

51. Entire Agreement

These Terms, together with the Privacy Policy and any additional policies published by Mechanic Jobs Australia, constitute the entire agreement between the parties regarding use of the Platform.

They replace all previous agreements, understandings and representations relating to the Platform.

52. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
